The Ministry of Finance has approved 8 risk indicators that will be identified at the federal state control over the production and turnover of tobacco and nicotine-containing products, raw materials for their manufacture. The order will come into force on July 20, 2024:
• Identification of the fact of the introduction into circulation of tobacco and (or) nicotine-containing products by a person engaged in the production of such products, in the absence of a state information system for monitoring the turnover of goods subject to mandatory labeling by means of identification (hereinafter - GIS MT), information on the purchase and (or) production by this person, respectively, of tobacco and (or) nicotine raw materials within 90 consecutive calendar days from the date of the last purchase and (or) production by this person, respectively, of raw materials and (or) nicotine raw materials until the day of identification of the fact of putting into circulation of the specified products.
• The absence in the GIS MT of information on the introduction into circulation and (or) withdrawal from circulation of tobacco products, and (or) nicotine-containing products, and (or) raw materials for their production within 40 consecutive calendar days from the date of the last introduction into circulation and (or) withdrawal from circulation of these products and (or) raw materials or within 50 calendar days from the first calendar day of the reporting quarter in aggregate by a person licensed in the field of production and turnover of tobacco products, nicotine-containing products and raw materials for their production, except in the case of suspension of the said license.
• Availability in the GIS MT on the last day of the calendar month of information on the remains of tobacco products with a period of more than 12 calendar months from the date of introduction into circulation of tobacco products in the amount of more than 25% of the total volume of tobacco products held by a participant in the turnover.
• Availability in GIS MT on the last day of the calendar month of information on the remains of nicotine-containing products with a period of more than 12 calendar months from the date of introduction of nicotine-containing products into circulation in the amount of more than 25% of the total volume of nicotine-containing products held by a participant in the turnover.
• Receipt by the Federal Service for Alcohol and Tobacco Market Control from the authorized bodies of the member States of the Eurasian Economic Union of information on the absence of registration as an economic entity in the territory of the relevant country of the Eurasian Economic Union of a person who, according to GIS MT, is a supplier to the Russian Federation of tobacco and (or) nicotine-containing products and (or) raw materials for their production.
• Identification of the fact of putting into circulation raw materials and (or) nicotine raw materials by a person licensed in accordance with part 1 of Article 8 N 203-FZ, providing for the licensee's right to put into circulation raw materials and nicotine raw materials, in the absence of GIS MT for 90 consecutive calendar days preceding the day of detection of the fact of putting into circulation raw materials and (or) nicotine raw materials, information on the supply and (or) withdrawal from circulation of raw materials and (or) nicotine raw materials in an amount exceeding 10 percent of the raw materials and (or) nicotine raw materials put into circulation.
• Identification of the fact of withdrawal of raw materials and (or) nicotine raw materials from circulation by a person licensed in accordance with part 1 of Article 8 N 203-FZ, providing for the licensee's right to withdraw raw materials and nicotine raw materials from circulation, in the absence of information on the purchase and (or) production of raw materials and (or) nicotine raw materials for 90 consecutive calendar days from the date of the last purchase and (or) production of raw materials and (or) nicotine raw materials until the specified withdrawal from circulation.
• Write-off of labeled tobacco products and (or) nicotine-containing products not put into circulation during one quarter in the amount of more than 10 percent of the total volume of these products put into circulation during the same period or write-off by a person licensed in accordance with part 1 of Article 8 N 203-FZ, providing for the right to enter when importing tobacco and (or) nicotine-containing products into the Russian Federation, labeling codes that have not been converted into identification tools, during one quarter, in the amount of more than 10 percent of the total number of marking codes received during the same period.
Risk indicators indicate possible violations of mandatory requirements, and their identification may become the basis for unscheduled inspections this year.
