The State Duma Committee on State Construction and Legislation recommended that the House of Parliament adopt in the first reading a bill to impose a fine for non-compliance with certain prohibitions in the field of production and trafficking of tobacco products.
The document was submitted to the State Duma in October 2024 by a group of deputies led by Maxim Topilin, chairman of the Duma Committee on Economic Policy.
It is proposed to amend the Code of Administrative Offences of the Russian Federation. For non-compliance with the prohibitions provided for by the law "On State regulation of the production and turnover of tobacco products, tobacco products, nicotine-containing products and raw materials for their production", it is proposed to impose a fine for individual entrepreneurs from 20 to 30 thousand. rubles with confiscation of products, equipment and raw materials. For legal entities, the fine can range from 100 to 150 thousand rubles.
The law "On State Regulation of the production and turnover of tobacco products, Tobacco products, nicotine-containing products and raw materials for their production" entered into force on March 1, 2024. According to the law, the turnover of tobacco products without labeling, the sale of tobacco products without consumer packaging, the retail sale of nicotine raw materials, the production and turnover of tobacco products and raw materials without providing information to the monitoring system are prohibited on the territory of the Russian Federation.
As stated in the explanatory note to the draft, these requirements are not licensed, and the Administrative Code does not establish administrative liability for violating non-licensed requirements. "In order to eliminate the legislative gap, the draft law proposes to introduce administrative liability for non-compliance with these requirements in the field of production and turnover of tobacco and nicotine-containing products," the explanatory note says.
