Rosspirtprom, whose sole founder and shareholder is the Russian state, was offered to deal with the destruction of tobacco products, products, raw materials seized from illegal circulation or confiscated, as well as consumer packaging used for their production. Such a draft Government resolution prepared by the Ministry of Finance was published on October 4 on the federal portal of draft regulatory legal acts.
The innovation was prepared in compliance with Federal Law No. 203-FZ of 13.06.2023 "On state regulation of production and turnover of tobacco products, tobacco products, nicotine-containing products and raw materials for their production".
This law provides that from March 1, 2024, it will be mandatory to have a license for the production, storage and supply of tobacco products, icos and vapes. The main technological equipment for the production of tobacco products will need to be registered in the state register.
According to the draft rules for the destruction of tobacco products and nicotine-containing products seized or confiscated by a court decision, the body authorized to execute such a decision will have to send a copy of it to the territorial authority of Rosalkogoltabakkontrol within five working days from the date of receipt of the judicial act.
There, specialists will also have to send an application for the destruction of products to the organization within five working days from the date of receipt of the document. It specifies, among other things, a description of the appearance of the goods, its distinctive features, as well as methods of destruction determined by the Ministry of Finance.
"The destruction of products and (or) items is carried out by the organization within 45 working days from the date of receipt of the request for the destruction of products and (or) items with the notification of the official (officials) of the territorial authority to ensure his participation in the destruction of products and (or) items," the document says. Based on the results of this procedure, it is proposed to draw up an appropriate act.
The draft resolution of the Cabinet of Ministers also establishes rules for the removal from the place of seizure or confiscation of such tobacco or nicotine-containing products, as well as rules for the dismantling, export and storage of technological equipment.
In August of this year, Russian President Vladimir Putin entrusted the functions of tobacco control to Rosalkogolregulirovanie. After that, the service changed its name accordingly. It was noted that the measure was taken in order to improve public administration in the field of production and turnover of tobacco products, tobacco products, nicotine-containing products and raw materials for their production.
