The State Duma Committee on State Construction and Legislation recommended that the State Duma adopt in the first reading bills on administrative and criminal liability, providing for fines of up to 1 million rubles or imprisonment for up to three years for the purchase, production, supply of tobacco and nicotine-containing products without a license, if necessary.
The document with amendments to the Administrative Code concerns administrative responsibility for offenses in the field of illegal production and trafficking of tobacco products, tobacco and nicotine-containing products and raw materials for their production. This responsibility is established by analogy with that provided for violations in the implementation of activities in the field of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products.
The second draft concerns criminal liability for carrying out activities in the field of production and turnover of tobacco products without an appropriate license, when it is mandatory. If such activity is carried out on a large scale, the fine can range from 500 thousand to 1 million rubles. As an alternative punishment, forced labor or imprisonment for up to three years with deprivation of the right to hold certain positions or engage in certain activities for the same period are possible.
The documents are being amended in connection with the preparation of the sectoral law "On state regulation of the production and turnover of tobacco products, nicotine-containing products and raw materials for their production."
